This Subscription Agreement ("Agreement") governs the purchase and use of paid subscriptions to The Gandy Plan™ ("The Gandy Plan™," "we," "our," or "us"). By purchasing a subscription, you agree to this Agreement in addition to our Terms of Service and Privacy Policy.
The Gandy Plan™ Version 1.0 offers the following subscription options (prices in U.S. Dollars):
Applicable taxes may be added where required by law.
From time to time, The Gandy Plan™ may offer free trials or promotional pricing.
Unless otherwise stated, your subscription will automatically convert to a paid subscription at the end of the promotional period unless canceled before renewal.
Subscriptions are billed through:
Your payment method will be charged by the applicable app marketplace at the beginning of each billing period.
The Gandy Plan™ does not collect or store your payment card information.
Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.
By subscribing, you authorize the applicable app marketplace to charge your payment method for each renewal.
You may cancel your subscription at any time through your Apple App Store or Google Play account settings.
Cancellation prevents future renewal charges but does not provide a refund for the current billing period.
After cancellation, you will continue to have access to your subscription through the end of the paid billing period.
All purchases are processed by Apple or Google.
Refund requests are subject to the policies of the marketplace through which the subscription was purchased.
The Gandy Plan™ does not directly issue refunds for purchases made through Apple App Store or Google Play.
We may change subscription pricing in the future.
If pricing changes, existing subscribers will be notified through the applicable app marketplace as required. Any price changes will take effect only after any required notice period and in accordance with Apple and Google policies.
An active subscription provides access to the current Version 1.0 features of The Gandy Plan™.
As the application evolves, new features, improvements, and enhancements may be included with your subscription or offered separately at our discretion.
Your subscription is intended for use by a single individual or business account as permitted by the app.
You may not share your account credentials with others or use your subscription in a manner that violates our Terms of Service.
You may not sell, resell, sublicense, rent, transfer, or commercially share your subscription or access to the Services, or use one subscription to provide unauthorized access to unrelated third parties.
We reserve the right to suspend or terminate access if:
To the fullest extent permitted by law, The Gandy Plan LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or the waitlist.
IN NO EVENT SHALL The Gandy Plan™ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, RELIANCE, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING , WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF PACE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability will not exceed the amount you paid for your subscription during the twelve (12) months immediately preceding the event giving rise to the claim.
We may update this Subscription Agreement from time to time.
If we make a material change to this Subscription Agreement, we will provide reasonable advance notice through the Services, by email to the address associated with your account, through the applicable app marketplace, on our website, or by another legally permissible method. The notice will state when the materially revised Agreement becomes effective.
Continued use of The Gandy Plan™ after updates become effective constitutes acceptance of the revised Agreement.
